Do I Need A Permit To Build A Deck In Winnipeg?

Are you looking to add a new decking area to your backyard? There can be no denying the many benefits of adding a deck to your home, but before you start construction, you must understand the rules.

One of the most common questions we are asked here at Blue Chip Decks is whether our customers require a permit to build a decking area on their property. That is why in this blog, we thought we would explore the topic further so you know what you need to do…

What are the rules for installing a new deck?

When it comes to building a new deck in Winnipeg, Manitoba, the rules are quite clear on what will require a permit and what does not. If your construction is over two feet high or has a surface area greater than 36 square feet (3.4 m2), then it is considered a deck and will need a permit in order to be built. It is important to point out that it makes no difference whether the construction is attached to your property or not.

Anything below these measurements is considered a platform and can be built without the need for a permit. This means that you do not require any paperwork or pay any fees, allowing you to create any space that you like. These smaller constructions are considered a landing or part of your landscaping, so they give you greater freedom.

If your new construction exceeds the sizing threshold and is considered a deck, then there are three key things to remember:

The first thing to remember is that you will need railings around the entire deck area. This applies to all areas above two feet but not those below it. That means if you have different levels, the lower part under the threshold will not require any permitting or railing.

The second key thing to remember is the structural guidelines for its construction. This is an extensive document that needs to be followed exactly in order to achieve full compliance. The rules are outlined in the wood decking handbook created by the city of Winnipeg.

Finally, you will also need to consider the location of the deck. The golden rule of building a new deck is that it cannot obstruct views or infringe on the property line. There are also particular rules on where it can be placed, including:

  • Needs to be behind the house.
  • Cannot go closer than four feet to the side property lines.
  • Cannot be within 25 feet of the back property line.

If you want to build a deck within this space, you will need to apply for a zoning variance. This typically takes around six weeks to process, costs $600, and requires the city to speak with your neighbours. Should it be OK, you will get confirmation, but should it be declined, you will not be refunded your application fee.

Submitting your application

Now you know the most important rules, the next step is to submit your application. This can be a very arduous process, especially if you have not submitted one before. It is very time confusing to put your application together, and the city does not make it easy as it can be very confusing and inconsistent, so expect to be required to make several amendments over the course of the submission.

We would also suggest you avoid submitting your application digitally. We have found that these kinds of applications tend to take a lot longer to process, and communication can often be missed. That is why you should make your application in person, ensuring that you are following all of the guidelines listed in the wood decking handbook.
